Terms of Service

These Terms of Service (“Terms”) govern your use of services provided by Streamline Marketing Consultants (“Company”, “we”, “us”). By engaging our services, you (“Client”, “you”) agree to the following:

1. Services

Streamline Marketing Consultants provides website design, development, hosting, and ongoing management for businesses.

Each engagement is defined by the scope outlined in your proposal, invoice, or service agreement. Any work requested outside of that scope may require additional approval and billing.

2. Billing & Payments

• Services are billed either as a one-time project fee or ongoing service plan, depending on your arrangement.
• Payment terms are outlined in your invoice and must be met to maintain active service.
• We reserve the right to pause or suspend services, including hosting, in the event of non-payment.

3. Hosting

For clients utilizing our hosting services:

• We manage the technical infrastructure, uptime monitoring, and baseline security of your website.
• While we aim for high reliability, uninterrupted service cannot be guaranteed due to reliance on third-party infrastructure.
• Hosting is tied to active service. If services are discontinued, hosting access will be removed.

4. Ongoing Management

Clients receiving ongoing management benefit from structured, consistent website support.

• Management includes one consolidated set of updates per calendar month.
• Requests are collected and implemented together to ensure efficiency and quality control.
• Additional requests may be scheduled for the following month or completed at an additional cost.

Priority Requests

• Time-sensitive updates may be accommodated outside the standard cycle when appropriate.
• Determination of urgency and scheduling is at the discretion of Streamline Marketing Consultants.

5. Client Collaboration

Successful outcomes depend on timely collaboration.

You agree to:

• Provide accurate content, assets, and direction
• Maintain rights to all materials submitted
• Respond to feedback and approval requests in a reasonable timeframe

Delays in communication may impact timelines and delivery.

6. Domain Management

If Streamline Marketing Consultants purchases or manages a domain on your behalf:

• The domain may be held within our registrar account for administrative efficiency.
• If you choose to transfer the domain away from our management:
  • A $150 transfer fee will apply
  • You are responsible for reimbursing all domain registration and renewal costs incurred by us
• Domain transfers are processed once all outstanding balances are cleared.

7. Ownership & Licensing

Websites provided by Streamline Marketing Consultants as part of our hosting and management services are delivered under an ongoing service model and are not transferred as owned assets upon creation.

• While services remain active, you are granted a non-exclusive license to use the website and its content for your business operations. Your website is built specifically for your brand, content, and goals. We do not replicate or resell your exact website to other clients.
• All underlying design, structure, code, and development frameworks remain the property of Streamline Marketing Consultants.
• We reserve the right to reuse non-proprietary elements, systems, and methodologies across other projects and to feature completed work in our portfolio unless otherwise agreed.

Website Transfer Option

• If you choose to discontinue services, you may request a full transfer of the website for a $500 transfer fee.
• Upon completion of payment, we will provide the website files and support a reasonable migration process.
• All outstanding balances must be settled prior to transfer.

8. Termination

• Either party may terminate services with written notice.
• Fees paid are non-refundable once work has been performed or a billing period has begun.
• Upon termination:
  • Hosting and management services will cease
  • Website files and assets may be transferred upon request, subject to account settlement

9. Limitation of Liability

Streamline Marketing Consultants operates with professional standards; however:

• We are not liable for indirect, incidental, or consequential damages, including loss of revenue or business interruption
• We are not responsible for issues caused by third-party software, hosting providers, or external services

Our total liability is limited to the amount paid for services within the previous 30 days.

10. Indemnification

You agree to indemnify and hold Streamline Marketing Consultants harmless from any claims or liabilities arising from:

• Content you provide
• Your use of the website
• Any violation of applicable laws or third-party rights

11. Updates to Terms

Streamline Marketing Consultants may update these Terms periodically. Continued use of our services constitutes acceptance of any revised Terms.

12. Governing Law

These Terms are governed by the laws of the State of California.

13. Acceptance

By engaging our services or selecting “I agree” during onboarding, you confirm that you have read, understood, and accepted these Terms.
